I want a divorce. Do I need an attorney?

The first step when seeking a divorce is to hire an experienced family law attorney in whom you can confide and trust.  Choosing the right attorney is crucial.  Hiring an attorney who is experienced in domestic or family law will provide you with comfort in knowing that he or she is not only knowledgeable about the legal intricacies of divorce but also sensitive to your emotions.  An attorney with experience in family law can provide you with the expertise needed to navigate complex legal frameworks and help ease the burden of decision making during a challenging time.

The details involved in a divorce vary.  Some of the issues can be the division of assets, property, and debts; child custody arrangements; child support obligations; and potential spousal support.  These are significant issues that need to be thoughtfully addressed, as they often determine your financial stability and family dynamics going forward.

Hiring an attorney does not mean that the divorce process will inevitably be fraught with hostility or that things will be “messy”; nor does it mean that there will be added costs or time commitments.  In fact, having an attorney to represent you can significantly streamline the process, helping to facilitate negotiations and communication.  An experienced attorney will work to advocate for your best interests while also encouraging a more amicable resolution when possible.

A party may choose to hire an attorney either before or after a Petition for Dissolution is filed, depending on their circumstances.  Sometimes, a person will take the proactive step of hiring an attorney before any filings are made, allowing for careful planning and guidance.  Other times, individuals seek legal advice after being served with a Petition filed by the other party, often in reaction to sudden developments.  Regardless of the order, it is important that you meet with an attorney and allow him/her to get to know you and the unique aspects of your situation.

While initiating a divorce may seem daunting, provoking mixed emotions and confused thoughts, it does not have to be this way. The emotional toll that accompanies the decision to end a marriage can feel overwhelming, causing anxiety and uncertainty about the future. However, having the right family law attorney on your side can help alleviate some of those fears.
